The Role Of Lawyers In Family Mediation: What The Future Holds

The role of lawyers in mediation has become increasingly important as society views mediation as an effective alternative dispute resolution mechanism to litigation. This paper attempts to explore such a role in three phases of the mediation process – the pre-mediation, during the mediation meeting, and post-mediation. The second part of this paper discusses the role of lawyers in the future of mediation – the common pressures against lawyers’ proper involvement in mediation.
