العدالة الانتقالية في ضوء قانون المصالحة الوطنية بالجزائرtransitional Justice In The Light Of National Reconciliation In Algeria Law

عرفت الجزائر عقب إلغاء المسار الانتخابي سنة 1992 أزمة أمنية حادة، بسبب تفشي ظاهرة الإرهاب، وهو ما دفعها إلى الاعتماد على المقاربة العسكرية كآلية لمعالجتها، غير أّن فشلها الذريع في تحقيق هدفها، دفعها نحو تبني الطرق السلمية، والمتمثلة في إصدار قانون للمصالحة والوئام المدني بغية تحقيق العدالة الانتقالية، بيد أنّ ضمان هذا القانون لسياسة التسامح مع الجُناة بداية من تخفيف العقوبات ووصولاً إلى العفو الشامل، حسب شروط حددها في مراسيم استثنائية خاصة، طرح العديد من الإشكالات القانونية، وعرضه للكثير من الانتقادات الحقوقية التي رأت فيه تناقضاً مع مبادئ العدالة الإنتقالية. على عكس توجه آخر نظر لقانون المصالحة الوطنية على أنّه تكييف لتلك المبادئ مع مختلف الظروف والخصوصيات السياسية، الاجتماعية والاقتصادية للجزائر. وقد راهنت الجزائر على هذا القانون من أجل إنجاح تجربتها في تحقيق الأمن والاستقرار السياسي من جهة، وتكييفه مع مبادئ العدالة الانتقالية من جهة أخرى. Summary Algeria suffered following the cancellation of the electoral process in 1992 of acute security crisis، because of the spread of the phenomenon of terrorism، which is paid to the reliance on military approach as a mechanism for control، but the utter failure to achieve its goal، pushed into adopting peaceful means، and of a law for reconciliation and civil harmony In order to achieve transitional justice، but to ensure that the law of the policy of tolerance with offenders beginning of an easing of sanctions through to the amnesty، according to the conditions set out in a special exceptional laws، raised many legal problems، and display of many of the human rights criticisms، which saw it as a contradiction with the principles of transitional justice . However، there are those who believe that the National Reconciliation Act in line with the different circumstances and peculiarities of political، social and economic Algeria. Algeria has bet on this law in order to experience success in achieving security and political stability on the one hand، and adapt it to the principles of transitional justice on the other.
