حماية القضاء الدولي لحقوق الإنسان جنائيا

إن الحماية الجنائية الدولية لحقوق الإنسان ودور الأجهزة القضائية الدولية في إضفائها من الناحية العملية موضوع حديث النشأة مقارنة بحداثة القانون الدولي لحقوق الإنسان أو القانون الدولي الإنساني ، فالقضاء الجنائي الدولي يشهد تطورا سريعا ومستمرا وقواعده تعرف مرونة غير متوفرة في منظومة القضاء الجنائي الوطني . ومن جهة أخرى فإن أهمية البحث تكمن في طبيعة الحماية التي يتناولها الموضوع في ظل بروز قيم إنسانية مشتركة بين كافة شعوب المعمورة تتفق كلها على ضرورة حماية الإنسان وصون كرامته والتأكيد على أمنه وسلامته ، واعتبار الانتهاكات التي تطال حقوقه الأساسية وكرامته الإنسانية خطرا يهدد السلم والأمن الدوليين. Abstract : International criminal law’s protection of human rights The protection offered by the international criminal low to human rights and the role of international judiciaries in implementing this protection on the ground is a newly-created subject if compared with the newness of the creation of human rights international law or the international human law. Thus, the international criminal law is witnessing fast and continuous development, its rules being of a flexibility unfound in the national justice’s system. On the other hand, the importance if the search lays in the nature of protection on which the subject focuses in a time when human values that are common between the world’s peoples have emerged and all agree on the necessity of protecting human rights & dignity and insist on human being’s security and safety. They also consider the violations of his fundamental rights and his human dignity as a threat to the international peace and security
