حرية التنقل وقيودها في ضوء المواثيق الدولية

ملخص: تعد حرية التنقل والإقامة من أهم الحقوق الأساسية للأفراد وهذا ما اقرت بها المواثيق الدولية والقوانين الوضعية كأصل عام، ولكن هناك قيود وضعتها المواثيق الدولية والقوانين الوضعية على هذه الأصل وهي إبعاد الأجانب والدول لها حق السيادة المطلقة في اقليمها بإبعاد الأجانب ومن مسببات إبعاد الأجانب ان يمس الفرد الأجنبي مصالح العامة لدول ومن حيث استقرار أمنها العام والصحة العام وعلى الدول ان تتقيد في مسألة إبعاد الأجانب عن اقليمها بعدم لتعسف في استعمال حقها، ومن جهة أخرى فلا يجوز ابعاد المواطن الذي يتمتع بجنسية دولته اطلاقا. ويهدف هذا البحث إلى إجراء دراسة شاملة أكثر دقة في تحديد حجم المشكلة ووضع آليات معالجة دولية فعالة لضمان حق الافراد في التنقل والإقامة من دولة الى اخرى حول تحديد القيود الواردة على ضمانات حق الافراد في التنقل والإقامة في ضوء المواثيق الدولية، وتحديد موقف المواثيق الدولية من الابعاد. Abstract: Freedom of movement and residence is one of the most fundamental rights of individuals. This is what has been recognized by international conventions and positive laws as a general principle. However, there are restrictions established by international conventions and statutes on this origin, namely, the expulsion of foreigners and states, which have the absolute right of sovereignty in their territory. The foreign interests of States and in terms of stability of their public security and public health. States must abide by the issue of alienation of foreigners from their territory by not arbitrarily exercising their right. On the other hand, citizens who possess the nationality of their State may not be expelled. The aim of this study is to conduct a more comprehensive and comprehensive study to determine the extent of the problem and to develop effective international mechanisms to ensure the right of individuals to move and stay from one country to another. The purpose of this study is to determine the restrictions on the right of individuals to move and live in the light of international conventions.
