الوضع القانوني للنزاع المسلح في سوريا إشكالية التكييف والحماية

لقد طال أمد النزاع المسلح في سوريا منذ عام 2011 إلى غاية يومنا هذا، وهذا الصراع المتطاول الأجل قد انعكس سلبا على وضعية حقوق الإنسان في البلاد خاصة الحق في الحياة وحظر التعذيب والمحاكمة العادلة، وأدى إلى وقوع انتهاكات خطيرة لأحكام ومبادئ القانون الدولي الإنساني وعلى رأسها مبدأ التمييز ومبدأ التناسب، ومما زاد من خطورة الأمر هو فشل الآليات الدولية في منع استمرار هذا النزاع وخاصة مع ظهور مبدأ مسؤولية الحماية، وهذه المسؤولية ملقاة على عاتق جميع الأطراف سواء كانت الحكومة السورية أو الجماعات المسلحة غير الحكومية. The armed conflict in Syria has been continuing on since 2011, this conflict reflected negatively on the human rights situation in the country, especially the right to life, the prohibition of torture and the right to a fair trial. This has led to serious violations of the provisions and principles of international humanitarian law, and especially the principle of distinction and the principle of proportionality. International mechanisms have failed to prevent the continuation of this conflict, and this has increased the seriousness of the matter, especially under the principle of responsibility to protect, and this responsibility rests with all parties, whether the Syrian government or non-governmental armed groups.
