أثر الإثبات الجنائي بوسائل التقنية الحديثة على حقوق الإنسان

ملخص: رغم التباين الفقهي بخصوص قيمة أدلة الإثبات الجنائي الحديثة، والتي من شأنها أن تؤدي إلى المساس بحقوق وحريات الأفراد الخاضعين لها، إلا أن بعض التشريعات –على غرار المشرع الجزائري- أجازت في بعض الحالات الإستثنائية استخدام هذه الوسائل في بعض الجرائم، مع فرض ضمانات قادرة على حماية حقوق وحريات المتهم أثناء خضوعه لمثل هذه الوسائل، مثال ذلك ما ورد لدى المشرع الجزائري في قانون الإجراءات الجزائية في المادة 65 مكرر 05، حيث تم الترخيص لوكيل الجمهورية بأن يأذن باعتراض المراسلات والتقاط وتثبيت وتسجيل الكلام أو التقاط الصور للمشتبه فيهم في جرائم المخدرات أو الجريمة المنظمة العابرة للحدود الوطنية، أو الجرائم الماسة بمعالجة الأنظمة الالية للمعطيات، أو جرائم تبييض الأموال، أو الجرائم المتعلقة بالصرف، وكذا جرائم الفساد. وفي المقابل أقر الدستور الجزائري بمقتضى المادة 40 منه ضمانات من قبل الدولة بعدم انتهاك حرمة الإنسان، كما تم حظر كل أشكال العنف المعنوي أو البدني أو المساس بالكرامة، بما يفيد ضرورة إحلال نوع من التوازن ما بين استخدام وسائل الإثبات الجنائي الحديثة، وبين احترام الضمانات القانونية التي تمنع المساس بحقوق وحريات الأفراد. Abstract: Despite the disparity of jurisprudence concerning the value of evidence of criminal Modern, which lead to prejudice the rights and freedoms of individuals, but that some of the legislation passed in some exceptional cases the use of these methods in some of the crimes, with the imposition of safeguards able to protect the rights and freedoms of the accused, for example, Article 65 bis 05 of the Algerian penal procedures Code, which has been licensed to the prosecutor to order the interception of correspondence and record speech or taking pictures of suspects in drug crimes or organized crime, transnational, or offenses against dealing with automated systems for data, or money laundering crimes as well as crimes of corruption. In contrast, the Algerian constitution approved under Article 40 guarantees by the state not to violate the human entity, and prevents all forms of moral or physical or compromising the dignity of violence, including stating the need to achieve a balance between the modern criminal proof, and respect for the legal safeguards that prevent prejudice to the rights and freedoms of individuals .
