The real estate development is one of the most modern and important investment regimes in the real estate sector. Thus, in order to protect the buyers, the legislator has organized the activity of real estate developer, mentioning his obligations, and the method of payment of the unit price since it is under construction. The legislator has also aimed to develop the appropriate means to more secure the unit buyers and the developer lenders, by obliging the developer to deposit the money received from them, in a security account, designated for this purpose. This creates trust between all these persons. So, if the developer fails to fulfill his obligations, they can easily sue him, and collect their money from the security account. The security account has organized by many legislations. It is created by a written contract concluded by the developer and one of the financial institutions or the banks that hold the payments or the loan. The account shall be opened under the name of the developer special project, and it will be designated to spend on building specific real estate project. This can protect the buyers and the tenders. This system is called “security account”. It will be the scope of our study.
